All provisions contained in the subsequent parts of these Terms of Cooperation apply to all agreements concluded between consumers and Eselcom OÜ (hereinafter referred to as “Eselcom” or “Seller”). These terms may only be amended based on individual written agreements signed by the consumer and Eselcom. The Terms of Cooperation are published on the website www.eselcom.com, under the “Terms of Cooperation” section.

The term “consumer” as used in the Terms of Cooperation of Eselcom is defined in Article 221 of the Civil Code of April 23, 1964 (Journal of Laws 64.16.93, as amended) and refers to an individual engaging in a legal transaction with an entrepreneur that is not directly related to their business or professional activities. Only individuals who are of legal age can be parties to agreements concluded with Eselcom.

Everywhere the Terms of Cooperation mention the “Catalogue,” it should be understood to mean a printed publication, CD/DVD discs, portable storage devices, the website, advertisements and press releases, leaflets, and any other means of publicly presenting Eselcom’s commercial information.

The consumer acknowledges that the products sold by Eselcom, unless otherwise certified by the manufacturer regarding the product’s intended use, have not been developed or intended for applications where a malfunction could lead to a situation posing a danger to human life or health, or to catastrophic property damage. Specifically, they are not intended for use in medicine for saving lives or sustaining life, in the nuclear field, or for the development, production, or other use in so-called supercomputers.

The consumer acknowledges that they must comply with the customs, export, and import regulations of the country to which the goods purchased from Eselcom are to be delivered, as well as obtain the necessary permits or licenses for the distribution, export, re-export, import of goods from their countries of origin, if the regulations of those states require such permits, and comply with the customs requirements of those states.

The consumer acknowledges that the legislative provisions of certain countries and international organizations impose restrictions on the trade of certain goods, corresponding technologies, and documentation with specific countries, organizations, or individuals. The consumer declares that, in light of applicable national and international law, they are not prohibited from acquiring the goods offered for sale by Eselcom.

The consumer agrees to comply with all official regulatory documents, in particular the provisions of laws, decrees, orders, decisions, and sanctions introduced on their basis, concerning so-called dual-use goods – to the extent that they relate to goods acquired from Eselcom (hereinafter: Goods), including, but not limited to:
- The U.S. Export Administration Regulations;
- The U.S. International Traffic in Arms Regulations;
- Economic sanctions laws and regulations implemented by the Office of Foreign Assets Control of the U.S. Department of the Treasury;
- European Union export control and sanctions legislation;
- United Nations sanctions policy;
- All relevant rules established under any of the aforementioned regulations;
- Other applicable economic sanctions, export control, or import rules (collectively referred to as “Export Rules”).

The consumer declares that:
- They will use the Goods exclusively for civilian end uses and will not use the Goods for unauthorized military end uses in accordance with the Export Rules;
- They will not allow end-users with restricted access to obtain the Goods, except as permitted by the Export Rules;
- They will not allow entities under sanctions or prohibitions to obtain the Goods, except as permitted by the Export Rules, including individuals listed in:
- The U.S. Specially Designated Nationals List, Denied Persons List, Entity List;
- The consolidated list of persons, groups, and entities subject to EU financial sanctions in accordance with the EU’s Common Foreign and Security Policy;
- They will not use the Goods for any end uses prohibited by the Export Rules, such as the development, modification, production, or manufacturing of nuclear, missile, chemical, or biological weapons, or for the development, enhancement, repair, or production of so-called supercomputers.

The consumer will not knowingly re-export, resell, transfer, or otherwise provide the Goods to third parties who do not unequivocally confirm that they will comply with the rules outlined in points 1.e – 1.h of these general terms.

The mandatory language version of the Terms of Cooperation is the Estonian language. Versions in other languages are intended for informational purposes only.
