Out-of-Court Methods of Claim Satisfaction
By mutual agreement of both parties, the consumer has the opportunity to utilize out-of-court methods for the resolution of complaints and the satisfaction of claims in continuously operating global consumer courts at voivodeship inspection offices of the Trade Inspection. Information about the rules for accessing this procedure can be found on the websites of the voivodeship inspection offices of the Trade Inspection or on the website of the Office for Competition and Consumer Protection www.uokik.gov.pl.
ODR Platform
Since February 15, 2016, there has been the possibility of resolving disputes between consumers and entrepreneurs through out-of-court means electronically via the European Union’s ODR (Online Dispute Resolution) internet platform.
The platform provides the opportunity to satisfy claims arising from online sales contracts or service contracts (as defined in the European Parliament and Council Regulation (EU) No 524/2013 of May 21, 2013, on a platform for online dispute resolution for consumer disputes, and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC), which are concluded between consumers residing in the EU and entrepreneurs located in the EU.
